Welcome to AskMemo (the "Service"), a website and Chrome extension developed and operated by Matthias Frank, based in Berlin, Germany and Alex Sherwood, based in the United Kingdom, (the "Owner" or "We"). By using the Service, you (the "User" or "You") agree to these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use the Service.
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
In order to use the Service, users must create accounts using their email and password or through Notion OAuth. You are responsible for safeguarding your account, and you agree that you will not disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account at hello@matthiasfrank.de.
The content provided on the Service, including but not limited to, the text, graphics, images, logos, icons, and the arrangement thereof, are owned by the Owner and protected by copyright, trademark, and other intellectual property laws. Notion and the Notion logo are trademarks of Notion Labs, Inc., and are used here with permission.
Please note that the Service is currently in a beta testing phase. This means that we are still testing the Service and there might be errors or other issues that could affect its performance. We will not be responsible for any data loss, damage, or other service interruptions that are related to using the Service.
Nothing in these Terms and Conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from negligence; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; (c) limit any of our or your liabilities in any way that is not permitted under applicable law; or (d) exclude any of our or your liabilities that may not be excluded under applicable law.
To the extent permitted by law, in no event will the Owner, or its officers, directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Any legal suit, action or proceeding arising out of, or related to, these Terms and Conditions or the Service shall be instituted exclusively in the courts of Berlin, Germany. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
